Some states have statutes defining marriage between one man and one woman. Others have Constitutional language defining marriage, and some have DOMA Constitutional Amendments. There are a few though that have no Law Prohibiting Same-Sex Marriage.
California, and the US, has had a long history of proposistions aimed at tackling the same sex marriage topic. Propostition 22 and the famous Prop 8 both set legislation in California banning same sex marriage. Prop 22 was reversed and Prop 8 is constantly challenged.
